Criminal Procedure: General Information

The initial disclosure provided by the Crown is not the only disclosure evidence. The Crown has an obligation to provide everything and this is an ongoing obligation. You might have two, three, four, five, even six appearances where the Crown is constantly providing disclosure evidence. It is also up to the Defence Counsel to ask for or to request disclosure if you think that you have not received all of the disclosure that there is to the case.

The next step is the Crown Pre-Trial. There could be a couple of Crown Pre-Trials and this usually entails a conversation between your Defence Counsel and the Crown assigned to the matter. This could take place in person, over the phone or by email.

Depending on your charge(s), sometimes you have to provide proof to the Crown. For example, in a domestic situation, if you have completed therapy or you are in therapy or you’ve completed an anger management course, your Defence Counsel would have to provide a completion certificate to the Crown.

Essentially, it’s very good to have a lot of conversations with a Crown because it’s means that you’re coming to a resolution to try and avoid going to trial if not necessary. There are matters where the Defence Counsel and the Crown do not see eye-to-eye and the Crown feels that your case should go to trial.

In this case, the next step is a Judicial Pre-Trial. This is a meeting between the Crown, Defence Counsel and the Judge. This is where you would receive a judge’s opinion on the matter. Usually there is one Judicial Pre-Trial, but you can have more than one Judicial Pre-Trial if there is a potential for a resolution in the case.

As you can see, there are some steps prior that can be taken to see if the case can be resolved prior to going to trial. It’s always important to understand that each case is different because it depends on the facts of the case so some cases will resolve quicker than others and other cases perhaps will end up going to trial. It’s quite important to be patient and always be in touch with your Defence counsel in case you have any questions or concerns.

Language Test Requirements for Skilled Worker Immigration Programs in Canada

FOR IMMEDIATE RELEASE

To qualify for Canada’s federal and provincial skilled worker immigration programs, applicants are to complete a language test requirements. This language test requirement applies to various skilled worker streams, including the federal Express Entry system and the Provincial Nominee Program (PNP).

The purpose of the language test is to assess and demonstrate the applicant’s language proficiency, ensuring they meet the language requirements of the specific skilled worker program they are applying to. Each program has its own set of test score requirements, typically measured against the Canadian Language Benchmark (CLB) levels.

The validity period for language test scores is two years. This means that applicants must submit their Canadian immigration application within two years of completing the language test. If more than two years have passed, the applicant will be required to retake the language test.

The Canadian government approves specific language tests for skilled worker applications. Currently, Immigration, Refugees and Citizenship Canada (IRCC) recognize the following language tests:

For English:

CELPIP General Test

IELTS General Training

Starting in late 2023, the Pearson Test of English (PTE) will be added as a third designated language test alongside CELPIP and IELTS.

For French:

TEF Canada: Test d’évaluation de français

TCF Canada: Test de connaissance du français

These approved language tests assess the applicant’s language skills in listening, reading, writing, and speaking abilities. The duration and format of the tests vary.

The CELPIP consists of four modules and can be completed in approximately three hours. The test can be taken in a single sitting, and results are typically available within 4-5 days after the test.

Similarly, the IELTS comprises four modules and takes approximately 2 hours and 45 minutes to complete. The speaking component can be taken up to seven days before or after the other three modules. Test results are typically available within 3-5 days for the computer-based test and 13 days for the paper-based test.

For French language proficiency, the TEF and TCF are accepted. The TEF is used to assess French comprehension and expression skills and is mandatory for various purposes, including immigration to Canada, and Quebec immigration, studying in France, obtaining citizenship in France, proving French language ability for work, and enrolling in certain programs as an international student. The test consists of written and oral sections with varying durations and costs depending on the location.

Similarly, the TCF assesses French comprehension and expression skills and is accepted for Quebec immigration purposes. It includes compulsory sections for reading comprehension, the use of language structures, and listening comprehension. Optional sections for spoken expression and written expression are available, with additional points awarded for these modules. The test duration and costs also vary based on the test location.

Skilled worker applicants must understand and meet the language test requirements specific to their chosen program. Adequate preparation and obtaining satisfactory test scores are essential to maximizing their chances of success in the skilled worker immigration process.

By meeting the language proficiency requirements, applicants demonstrate their ability to communicate effectively in English or French, which is vital for integration into Canadian society and the labour market.

Top 5 Things to Know when Getting Divorced

If you are considering getting divorced, it is important that you understand your rights and obligations. Going through a divorce is a major life event and can cause disruptions to your family, finances, and lifestyle. Ensure that you have all the information possible before you begin the divorce process, in order to be prepared. Today we will go over 5 things that you should know when you are getting divorced.

1. What is the Difference Between Separation and Divorce?

While divorce and separation may seem similar, they are in fact quite distinct. Separation occurs when a common-law or married couple decide to live separately and apart. Common-law couples can go through a separation, but as they were never married, they do not need to go through a divorce.

Undertaking a separation is the first step of getting divorced, and married couples that have been living separate and apart for at least one year can then file for divorce. Once the divorce has occurred, they are no longer legally married and can then remarry, while a separation does not legally dissolve a marriage.

2. When can I File for Divorce, and How Long does it Take?

Once you and your spouse have been separated for one year, it is then possible to file for divorce. The divorce process can take some time, so you should not expect that after one year of separation has passed that you will be divorced.

Processing times for divorce cases can vary on several factors, including the complexity of division of assets, child custody agreements, and the emotions of the spouses. Generally, for the divorce process to be finalized it will take from 6-10 months.

3. Who will Get my House?

In the case of a divorce your assets will need to be divided, including your home. The property that a married couple purchases or lives in during their marriage is called the matrimonial home. Each spouse is equally entitled to the matrimonial home, and the spouses will need to come to an agreement on whether they will sell and divide the profits, or if one spouse will remain in the house. This can be a complicated process that can be facilitated with the help of a divorce lawyer.

4. What if my Spouse Doesn’t Cooperate?

You may find that throughout the divorce process, your spouse does not wish to cooperate, and you may enter a dispute. This is not uncommon, as emotions tend to run high, no matter how amicable a split. There are several ways that you can resolve disputes with your spouse, including engaging in alternative dispute resolution. This can include mediation, arbitration, and negotiation. These avenues should be explored before involving the court in order to save both parties time and additional costs.

Our bookkeepers can assist you in setting up your initial payroll service in QBO or Gusto. We are not responsible for entering payroll hours/salary, accruing payroll taxes, nor the transmittal of payroll taxes to the IRS or the state.  Your full-service payroll provider (QBO, Gusto, or whatever other service a client uses) will be the responsible party for payroll and payroll tax compliance.

*Payroll deductions and benefits

We provide assistance with setting up a payroll account in either Quickbooks Online or Gusto, including entry of employee data.  We do not assist in state registrations, benefits, or advise on deductions.  Those service areas are provided directly by either QBO or Gusto.

Preparation of W2s

Similar to the last item, your full-service payroll provider (QBO/Gusto) is responsible for preparation of Form W2 for employees.

Sales tax reporting

For those nonprofits that sell taxable goods and/or services, your bookkeeper will assist in accounting for sales taxes collected and transmitted, but we do not prepare state sales tax reports.

Donation recording

We do not provide individual donation data entry into your neither your donor CRM nor Quickbooks Online, nor do we prepare year-end donor acknowledgements.

Administrative tasks

We cannot provide administrative services unrelated to our bookkeeping function.

Attend board meetings

Due to the constraints of time and distance, we are unable to be present, physically nor virtually, at a meeting of a client’s board of directors.*May incur additional fee per 1099-NEC or 1099-MISC.

Is a Charity Allowed to Get Involved in Politics?

Some people might say that political parties engage in activities that are largely for the greater good. Most do, to a greater or lesser extent, albeit with their own goals in mind. But when it comes to charities, largely is not good enough. There are clear, well defined rules when it comes to charities being involved in politics (and vice versa) and it’s a good idea to know them before you start a charitable organization.

A Legal Issue

The definition of a charity is a little vague in Canada. Which might be why some people aren’t entirely sure what’s allowed and what’s not. However, while they don’t quite spell out exactly what you can do, they are transparent about some of the things you can’t. Political activity falls squarely into the latter category.

According to Canadian law, any organization that is founded for political purposes cannot be a charity. The definition of political purposes includes supporting or furthering a political party or candidate, or to be involved in an attempt to change, retain, or alter any laws or legal policies, whether inside or outside of the borders of Canada.

Even if these goals might benefit society, they require a charity to choose a side, and that, according to Canadian law, is not allowed. So, while you might pursue a charity that helps people, animals or even religious organizations that are affected by those kinds of laws, a charity cannot seek to change the law itself.

Who Decides What Is Allowed and What Is Not?

As you might have already gathered from the above-mentioned legal issue, there’s quite a lot of room for interpretation when it comes to charities, what they do, and what they are allowed to do.

However, in the Canadian system, there is a noticeably clear distinction between politics, which takes place in parliament and legislatures, and the law, which always happens in the court system. Neither wants to get involved in the other’s activities, so courts will usually be quick to act when there’s some overlap between politics and charity.

Subordinate and Primary Purposes

As if things weren’t already murky enough when it comes to the line between politics and charity, there are also some rules that might seem to override everything you’ve read to this point. Politics is one of these areas.

Of course, it’s almost impossible to completely divorce politics and charity in every way, since many of the social ills charities choose to address are the result of political actions or inactions. However, charities are required to have a stated purpose, and while there may be some opposition to political ideology in that purpose, it’s important to keep them separate.

When, according to to the law, a charity’s “collateral” political activities become too much of a focus, there may be a legal question about whether they are still pursuing their stated purpose.

In other words, while a charity may seek to help uplift persecuted women in a particular country, for instance, they can’t shift their focus to changing the laws of that country to better protect those women.

What Does It All Mean?

As with so many things related to the law, there are quite a lot of ifs, ands and buts involved when you are talking about politics and law. There is some leeway, but since you won’t really know where you fall on the scale until you find yourself on the wrong side of the line, it’s best to avoid the issue altogether.

The safest way to ensure that your charity does not get involved in a legal battle about allowable activities is to just to focus on your mission and leave the activism and politics to others.

Structure your activities and focus on things that you know are not related to politics. Stay neutral and don’t support or condemn any political party or figure. Never try to change the laws, even if they might create the situation that you are trying to fix. Very often, that is exactly what does happen, but try to remember that if you lose your charitable status, you will also lose your ability to help.

When it comes to running a charity, political neutrality is the safest and easiest way to avoid trouble, and it’s the one we recommend. Stay focused on your mission, and trust that with time, the politics will correct itself.

What’s the difference between Assault, Domestic Assault, Aggravated Assault and Sexual Assault?

Assault

Assault, often referred to as simple assault, is where one person does something which is forceful, or which threatens force to another person without their consent or permission. Contrary to what many people believe, to be charged and convicted of assault, there is no requirement of physical contact, or consequently, for the complainant to have sustained physical harm or injury.

Assault is a hybrid offence as the Crown prosecutor can choose, based on factors such as the seriousness of the actions and the harm caused, to treat the offence as a summary conviction or an indictable offence.

Domestic Assault

A person commits assault when they intentionally cause a physical injury to another person. Domestic violence is any event such as stalking, kidnapping, false imprisonment that causes physical injury or the fear of physical injury between family members or household members.

You cannot get domestic assault charges dropped in Ontario if the complainant decides to withdraw the charges. Canadian law says that victims of an assault cannot simply drop criminal charges against the accused. Only the police and the Crown Attorney can decide whether the charges will go forward to trial.

In Canada, the penalties for domestic assault depend upon the circumstances of each case and can range from a peace bond to jail time. If the Crown is proceeding by summary conviction (less serious offences), the offender may be required to pay restitution to the wronged party or pay for property damage or medical bills. If the crime does not warrant a jail sentence, the offender may receive a suspended sentence (i.e. Remain under probation) or conditional sentence (i.e.: house arrest).

However, if the Crown is proceeding by indictment (most serious offences), it is likely that the assault was very serious in nature and the accused will face jail time if convicted. For charges such as sexual assault or assault causing bodily harm, the accused can face up to 10 years in prison. However, if the conviction is for aggravated assault, the accused can face up to 14 years in prison.

Aggravated Assault

Aggravated assault is the most serious form of assault short of actually causing death. A person can be convicted of aggravated assault when their actions lead to another person being wounded, maimed, disfigured, or if they endanger someone’s life. For example, a lasting facial wound (permanent scar) caused by a broken beer bottle in a bar fight would be considered to be an aggravated assault.

  1. Wound
    breaking of the skin.
  2. Disfigure
    involves more than temporary impairment of a person’s figure or appearance.
  3. Endangered life
    real risk to a person. Actual bodily harm is not necessary.
  4. Maim
    to injure another person so much that they are less able or unable to fight back.

Factors that raise an assault to the aggravated level typically include the use of a weapon, the status of the victim, the intent of the perpetrator, and the degree of injury caused.

Aggravated assault is a very serious felony charge; a conviction for this crime can seriously impact your life. You could face a lengthy prison sentence and the stigma of being a convicted felon. Convicted felons cannot vote or possess firearms and often have difficulty finding employment.

Everyone who commits an aggravated assault is guilty of an indictable offence and liable to imprisonment for a term not exceeding fourteen years. Sexual Assault

Sexual violence takes different forms and can include:

Everyone who commits a sexual assault is guilty of (a) an indictable offence and is liable to imprisonment for a term of not more than 10 years or, if the complainant is under the age of 16 years, to imprisonment for a term of not more than 14 years and to a minimum punishment of imprisonment for a term of one year; or (b) an offence punishable on summary conviction and is liable to imprisonment for a term of not more than 18 months or, if the complainant is under the age of 16 years, to imprisonment for a term of not more than two years less a day and to a minimum punishment of imprisonment for a term of six months.

Proposed Changes to Canada’s Express Entry Criteria

Modifications have been proposed to Canada’s Express Entry system, which would change the way foreign workers are selected to be invited to apply for permanent residency. Under current rules, the immigration minister does not have the ability to invite candidates from the Express Entry pool based upon certain work experience, educational credentials, or language skills. The proposed changes, however, will allow the immigration minister to invite candidates based on these criteria to fulfill a stated economic goal.

What is Express Entry?

Express Entry refers to an application management system for three Canadian immigration programs: the Federal Skilled Worker Program (FSWP), the Canadian Experience Class (CEC), and the Federal Skilled Trades Program (FSTP). In order to immigrate to Canada through one of these programs, foreign workers must express their interest by completing a profile in the Express Entry system.

Due to the pandemic, FSWP and CEC draws have been temporarily paused, and only candidates from Provincial Nominee Programs (PNPs) have received invitations to apply. However, the programs are on track to reopen for candidates in the summer of 2022.

After completing their applications, eligible candidates will receive a score based on their work experience, educational background, language skills, age, and a variety of other factors. Currently, candidates who receive the highest scores are invited by the IRCC to apply for permanent residence. With the proposed amendment, the way that candidates are selected to apply for permanent residence would change; they would be assessed according to criteria additional to their application score.

What are the Proposed Changes?

The changes are meant to improve Canada’s ability to select applicants that match its current economic needs. Under the amendment, Canada would be able to conduct targeted draws aimed at selecting individuals who possess skills that address areas like Canada’s labour shortages, or that would help Canada reach other economic goals as defined by the immigration minister.

Those who fit these criteria would be added to a preferred category within the immigration pool, and invitations would be sent out to top-ranking candidates within that category. Factors such as work experience, educational background, or language skills could become eligibility requirements to become a member of a specific category, and therefore prioritized for immigration. For example, if there was a desire to support Canada’s tech industry, category criteria could be based on work experience in the sector or a specific educational credential. This categorization could be applied to any industry in which Canada is experiencing a shortage or need, such as the healthcare industry.

Express Entry Criteria & Transparency

You might be wondering how you will know if you fit into an Express Entry category under these proposed changes. Draw details, including unique eligibility criteria, would still be published on the IRCC Website. The specific economic goal that the category is seeking to fulfill would also be disclosed, and the immigration minister would report annually to Parliament on the use of the draws.

However, critics believe that further oversight will be needed, including transparent, formal, and established criteria for determining the categories. This oversight would ensure fairness in selecting the categories, what criteria would be prioritized, as well as prevent the draws from becoming overtaken by lobbyists. Currently, the proposed changes are being researched, and requested changes to the amendment will be considered on May 27.

5 Benefits to Becoming a Canadian Citizen

If you have been living in Canada as a Permanent Resident (PR) you may not feel that you need to take the next step and obtain Canadian Citizenship. As a Canadian Citizen, you will be able to call yourself a Canadian, and have pride in your new country… but what other benefits are there to becoming a citizen? 1. No Need to Renew Your Status

In Canada, most PR cards are only valid for 5 years, at which point you will need to renew. You will need to go through this renewal process regularly if you remain a Permanent Resident no matter how long you live in Canada. During the 5-year period, you will need to meet residency requirements; 730 days must be spent in Canada to retain your PR status. This can be limiting if you hope to travel or live abroad for lengths of time while maintaining your status in Canada.

If you are a Canadian Citizen, however, there is no need to renew your status. While you may still see some residence requirements as a citizen to retain healthcare coverage, for example you will have much more flexibility in the length of time you spend in Canada vs. abroad.

To apply for Canadian Citizenship, you must have lived in Canada for 1095 days in a 5-year period. You may even be able to reach this number in your first term as a Permanent Resident!

2. Protection Against Losing Status

Similarly, if you are a Canadian Citizen you will benefit from additional protections to your status, as there are very few circumstances in which a Canadian Citizenship can be revoked. As a Permanent Resident, you can still be deported no matter how long you have lived in Canada.

If you are convicted of a crime, for instance, depending on the seriousness, you may have your PR status revoked and be deported to your home country. However, if you are a Citizen, you will not face such consequences.

There are some situations in which a citizenship could be revoked. If you have obtained your citizenship through false means or fraud, pose a threat to national security, have committed human or international rights violations, or are involved in organized crime, you could be at risk of having your citizenship revoked.

3. Increased Job Opportunities

If you become a Canadian citizen, you will also have access to an increased job pool. Canadian Citizens can apply for jobs that are not available to Permanent Residents, including some government jobs. Some jobs also require security clearances that are only available to citizens. If you are on the hunt for employment, or would like to break into previously unattainable industries, you should work on becoming a Canadian Citizen.

4. Right to Vote

Another benefit to becoming a Canadian Citizen is that citizenship gives you the right to vote in all elections. Voting will allow you to play an important role in influencing Canadian policies by voting for representation based on your own views. You will also be able to run for elected political office where you will be able to further represent your community, influence policy, and play a crucial role in the Canadian political system.

5. Canadian Passport

Finally, gaining Canadian Citizenship will give you access to the Canadian passport. The Canadian passport is very valuable internationally, since many countries worldwide allow Canadians to enter without a visa for approved purposes, such as tourism travel.

Additionally, Canada recognizes dual citizenship, so you may be able to hold two passports your Canadian passport, and that of your home country. If your home country does not allow dual citizenship, it is important to weigh the strengths and weaknesses of the two passports against each other so you can determine which is the better choice.

Can I create a charity that supports Indigenous Communities in Canada?

Charitable organizations that serve the needs of Indigenous communities fall under the recognized category of philanthropic purposes. These purposes extend beyond providing direct assistance to the community and include other beneficial activities acknowledged as charitable under the law. This rule is for groups that help Indigenous people in Canada.

To become a charity, a group has to prove that what they do helps the public or is a big part of it. Courts have affirmed that organizations with restricted purposes and activities related to the needs of Aboriginal Peoples of Canada qualify as philanthropic entities, meeting the public benefit test.

Groups that create programs for Indigenous peoples that respect their traditions, customs, and cultural needs can become charities.

Organizations may be eligible under the broader category of charitable purposes, including shelters for youth or victims of abuse

  • family counseling services
  • suicide prevention lines
  • rape crisis centers
  • counseling centers for alcoholism and substance abuse
  • organizations addressing medical conditions prevalent in Aboriginal communities,
  • youth groups, drop-in centers, seniors’ recreational associations
  • community centers
  • and facilitators for community well-being.

However, organizations cannot justify restricting their benefits solely to the Aboriginal peoples of Canada. These include

  • hospitals
  • ambulance services
  • fire protection services
  • disaster relief funds
  • rescue and safety organizations
  • Meals on Wheels
  •  block parents
  • recycling services
  • environmental protection organizations
  • parks
  • recreational grounds.

If an indigenous charity only allows people from one nation and excludes others, it doesn’t meet the requirement of benefiting the public. To be allowed to target a specific indigenous nation, the organization must demonstrate that it addresses a charitable need specific to that limited group(e.g., issues faced only by the Métis or a particular nation).

We’re often asked by prospective clients what our Bookkeeping Service covers?  People want to know what specific tasks we do, and what their responsibility is.  This brief explainer page will answer that question.  This is by no means an exhaustive list, but covers the most frequently asked questions.

Getting Started

  • Review your existing books for needed corrections or back-work
  • Chart of accounts setup or amendment
  • Assistance with setting up bank feeds
  • Limited assistance* with setting up payroll (QBO or Gusto only)

Ongoing Monthly Bookkeeping

  • After-the-fact transaction recording

  • Assistance with 1099-NEC preparation*
  • Assistance with 1099-MISC preparation*
  • Year-end financial statements and period-end closing

What We Don’t Do

Pay bills

We do not offer bill-pay services at this time, nor do we manage Accounts Payable (AP) or Accounts Receivable (AR).

Payroll tax responsibility

Our bookkeepers can assist you in setting up your initial payroll service in QBO or Gusto. We are not responsible for entering payroll hours/salary, accruing payroll taxes, nor the transmittal of payroll taxes to the IRS or the state.  Your full-service payroll provider (QBO, Gusto, or whatever other service a client uses) will be the responsible party for payroll and payroll tax compliance.

*Payroll deductions and benefits

We provide assistance with setting up a payroll account in either Quickbooks Online or Gusto, including entry of employee data.  We do not assist in state registrations, benefits, or advise on deductions.  Those service areas are provided directly by either QBO or Gusto.

Preparation of W2s

Similar to the last item, your full-service payroll provider (QBO/Gusto) is responsible for preparation of Form W2 for employees.

Sales tax reporting

For those nonprofits that sell taxable goods and/or services, your bookkeeper will assist in accounting for sales taxes collected and transmitted, but we do not prepare state sales tax reports.

Donation recording

We do not provide individual donation data entry into your neither your donor CRM nor Quickbooks Online, nor do we prepare year-end donor acknowledgements.

Administrative tasks

We cannot provide administrative services unrelated to our bookkeeping function.

Attend board meetings

Due to the constraints of time and distance, we are unable to be present, physically nor virtually, at a meeting of a client’s board of directors.*May incur additional fee per 1099-NEC or 1099-MISC.
