What to Do If You’re Charged with a Criminal Offence in Ontario

FOR IMMEDIATE RELEASE

Being charged with a criminal offence in Canada is a life-altering experience. It often brings confusion, fear, and uncertainty. Whether it’s an assault allegation, a driving offence, or a financial crime, your actions in the first 24 to 48 hours can heavily influence the outcome of your case. Knowing your rights and the immediate steps to take can mean the difference between conviction and acquittal. Northfield & Associates, a firm with offices in Cambodia and Canada region, provides expert legal representation for a wide range of criminal offences and is dedicated to protecting your rights from day one.

Your Legal Rights Upon Arrest

When you’re arrested in Ontario, the Canadian Charter of Rights and Freedoms guarantees you certain fundamental protections:

Right to Be Informed of the Reason for Arrest

Police officers must explain in clear language why you are being detained. If you’re not told what you’re being charged with, the arrest can be challenged later in court. This is a foundational right ensuring transparency in law enforcement.

Right to Remain Silent

You are not obligated to answer any questions other than confirming your identity. Anything you say can and likely will be used against you in court. People often believe they can talk their way out of a situation, but more often than not, this harms their case. The safest move is to say, “I want to speak to my lawyer.”

Right to Speak to a Lawyer Without Delay

Upon arrest, you must be given an opportunity to contact legal counsel as soon as reasonably possible. You can speak to a private lawyer or duty counsel (a free legal advisor provided by Legal Aid Ontario and/or across Canada). This ensures that you receive legal advice before participating in any police interviews.

Right to Be Informed of These Rights

Officers must not only inform you of your rights but also ensure you understand them. If you don’t speak English fluently or have cognitive limitations, the police must accommodate this. If your rights are not properly explained, any evidence collected may be inadmissible in court.

Immediate Steps After Being Charged

Remain Silent and Calm

Resisting arrest or becoming aggressive can lead to additional charges, such as obstruction or resisting arrest. Stay calm, follow instructions, and limit your speech.

Contact a Criminal Defence Lawyer

Call Northfield & Associates immediately. Our criminal defence lawyers have experience handling a variety of criminal matters, including high-stakes cases. A lawyer can begin building your defence right away by protecting your rights, collecting time-sensitive evidence, and intervening in police procedures if necessary.

Avoid Discussing the Case

Even casual conversations with friends or family can become part of a police investigation. Refrain from discussing your case with anyone until you’ve spoken extensively with your lawyer. This includes phone calls from jail, which may be recorded.

Collect and Preserve Evidence

If you’re released after arrest, take immediate steps to document what happened: note timelines, locations, conversations, and possible witnesses. This information will help your lawyer construct a timeline and identify weaknesses in the prosecution’s case.

Bail Hearings

In most cases, bail hearings take place within 24 hours of your arrest. This is a critical stage where your liberty is at stake. Bail hearings determine whether you’ll be released pending trial or held in custody.

Northfield & Associates has extensive experience representing clients at bail hearings. We assess the Crown’s grounds for detention and present robust plans of release often including sureties (people who supervise the accused) or specific conditions (e.g., curfews or no-contact orders).

Grounds for Denial of Bail

1. Primary Ground:

Ensuring the accused’s attendance in court.

2. Secondary Ground:

Public protection or risk of committing further offences.

3. Tertiary Ground:

Maintaining public confidence in the administration of justice, especially in serious cases.

Bail hearings must be handled strategically. Poor planning or weak proposals can result in pre-trial detention, which is not only demoralizing but may negatively affect the trial outcome.

Specific Criminal Charges and Their Defences

Domestic Assault

These cases often involve conflicting narratives and emotional dynamics, where even minor altercations can result in charges if police believe that violence has occurred. Ontario often enforces a zero-tolerance approach, which can lead to formal charges being laid without the need for corroborative evidence. At Northfield & Associates, we understand how difficult this process can be for victims seeking justice. We work diligently to advocate for their rights, support their role in the criminal process, and ensure that their voices are heard and respected. From assisting with police statements and securing protection orders to guiding clients through the complexities of trial, we are committed to resolving domestic assault cases with discretion and sensitivity. Our goal is always to pursue outcomes that promote both safety and accountability, while minimizing further trauma to those affected.

Sexual Assault

At Northfield & Associates, we are committed to advocating for victims of sexual assault. These cases are deeply personal and emotionally taxing. We understand the trauma that survivors endure, and we work tirelessly to ensure their voices are heard and their rights upheld throughout the legal process.

We help victims navigate the complexities of reporting the assault, preparing for testimony, and understanding what to expect in the criminal justice process. Our team ensures that victims are treated with dignity and respect, both in and out of the courtroom. We also assist in securing protective measures such as restraining orders or no-contact orders, and we liaise with police and prosecutors to support the case every step of the way.

Northfield & Associates provides compassionate, experienced legal support for survivors while fiercely pursuing justice against those who have caused harm.

Assault and Aggravated Assault

Northfield & Associates represents victims of assault, including aggravated assault, which involves serious bodily harm or life-endangering injuries. Victims may suffer physically, emotionally, and financially, and we help them seek justice through the criminal courts.

We assist clients in filing police reports, gathering medical and witness evidence, and advocating for their rights during trial proceedings. Our legal team ensures that clients understand their role in the prosecution’s case and helps them prepare for their participation in court.

We also work to ensure victims have access to appropriate support services and pursue restitution or civil remedies where available. At Northfield & Associates, we stand firmly beside assault victims as their advocates and legal representatives.

Dangerous Driving

These charges can arise from momentary lapses in judgment or more serious acts of negligence behind the wheel. When representing victims in dangerous driving cases, Northfield & Associates takes a thorough approach to uncover the full context of the incident. We work to demonstrate that the accused’s actions clearly met the legal threshold for dangerous operation, such as excessive speeding, distracted driving, or disregard for public safety. We gather evidence from accident reconstruction experts, assess road and weather conditions, and scrutinize mechanical inspections to build a compelling case that supports the victim’s account and highlights the serious consequences of the driver’s behaviour.

Fraud and Theft

White-collar crimes involve intent to deceive, often backed by financial records and complex financial transactions. When representing victims of fraud or theft, Northfield & Associates works meticulously to uncover and present evidence that clearly demonstrates intentional wrongdoing. We help clients navigate the process of reporting the crime, preserving financial records, and working with forensic accountants to trace misappropriated funds. Our team challenges any attempts by the defence to minimize culpability by proving that actions were deliberate and not the result of misunderstandings. We also work toward recovering stolen assets and advocate for full accountability through both the criminal justice system and potential civil remedies. With experience in handling intricate fraud cases, we ensure victims have the strongest representation possible.

Young Offenders

The Youth Criminal Justice Act (YCJA) emphasizes rehabilitation over punishment, particularly for young individuals whose actions may stem from immaturity, peer pressure, or difficult personal circumstances. Charges under the YCJA can range from non-violent offences like mischief or theft to more serious crimes involving violence. At Northfield & Associates, we support youth victims and their families by ensuring their interests are represented compassionately and firmly. We advocate for diversion programs or extra-judicial sanctions where appropriate, especially in cases where restorative justice can bring meaningful resolution. Our team also works to protect the long-term interests of youth by ensuring records are expunged post-sentence when possible, safeguarding their future educational and employment opportunities. We collaborate closely with parents, educators, and youth counsellors to secure outcomes that promote healing, accountability, and community safety.

Important Update: Changes to Express Entry – Removal of Arranged Employment Points

March 25, 2025 — Immigration, Refugees and Citizenship Canada (IRCC) has officially removed the arranged employment points from the Comprehensive Ranking System (CRS) for Express Entry candidates.

What Does This Change Mean?

Previously, candidates with a valid job offer supported by a Labour Market Impact Assessment (LMIA) could earn between 50 and 200 CRS points, which significantly improved their chances of receiving an Invitation to Apply (ITA) for permanent residence (PR).

However, this policy change now means that candidates no longer receive additional CRS points for arranged employment, making job offers less impactful in the CRS score calculation.

Who Is Affected?

  • Current Candidates
All Express Entry candidates who were previously benefiting from arranged employment points and were in the Express Entry pool on or after March 25, 2025 will be affected by this change.
  • Candidates with an ITA
Those who have already received an ITA or are in the process of obtaining permanent residence will not be impacted by this adjustment.

What Does This Mean for You?

If you are an Express Entry candidate who relied on arranged employment points to boost your CRS score, this change may impact your overall ranking within the pool. It’s now more important than ever to explore other avenues to strengthen your profile, such as:

  • Improving language scores
  • Gaining additional work experience
  • Securing a provincial nomination through the Provincial Nominee Program (PNP)

At Northfield & Associates, we understand how these changes may affect your immigration strategy. Our team is here to provide expert advice and guide you through the revised Express Entry process, ensuring that you remain competitive and informed.

LMIA Express Entry Changes 2025: What You Need to Know

Canada has recently introduced major updates to its Express Entry system that directly impact LMIA-supported job offers. As of March 25, 2025, Immigration, Refugees and Citizenship Canada (IRCC) has removed the CRS points for arranged employment, including those supported by a Labour Market Impact Assessment (LMIA). This press release explains how these changes affect immigration candidates and how Northfield & Associates can support your journey.

What Is an LMIA Job Offer in Canada?

A Labour Market Impact Assessment (LMIA) is a document that employers in Canada may need before hiring a foreign worker. When a job offer is backed by an approved LMIA, it was previously considered a strong advantage under the Express Entry system, adding 50 to 200 CRS points to a candidate’s profile.

Many applicants relied on an LMIA job offer in Canada to increase their chances of receiving an Invitation to Apply (ITA) for permanent residence. But that has now changed.

LMIA Express Entry Changes 2025:

What Has Changed?

The biggest update is that arranged employment CRS points have been removed. Until now, Express Entry candidates received:

  • 50 CRS points for a valid job offer in a NOC TEER 1, 2, or 3 job
  • 200 CRS points for a job offer in a senior management position (TEER 0)

As of March 25, 2025, these CRS points for job offers in Canada no longer apply. This means candidates with an LMIA-based job offer will not receive extra points in the Express Entry draw.

Why Did IRCC Remove CRS Points for Arranged Employment?
According to IRCC, this change helps reduce the misuse of LMIA job offers. The government wants to prevent cases where candidates pay for job offers, which is illegal in Canada.

The new system focuses more on human capital factors like age, education, language ability, and work experience rather than job offers. It encourages fairness and ensures that the Express Entry system reflects the best candidates without manipulation.

Who Is Affected by These CRS Score Changes?

The LMIA Express Entry changes in 2025 will impact many skilled workers applying for permanent residence in Canada.

Candidates With LMIA Job Offers

If you relied on an LMIA-supported offer to boost your CRS score, you may now fall below the cutoff in future Express Entry draws.

For example:

  • A candidate with a CRS score of 480 plus 50 points for a job offer (total 530) will now remain at 480
  • This can affect your ranking in the pool and delay or block your ITA

Candidates Without Job Offers

If you applied through Express Entry without a job offer, this change may help you. Since fewer candidates will have artificially boosted scores, you may now be more competitive in the pool.

Express Entry Without Job Offer in 2025:

Is It Still Worth Applying?

Yes. Many candidates have successfully immigrated through Express Entry without a job offer.

You can now focus on:

  • Improving your language test scores (IELTS, CELPIP)
  • Gaining more skilled work experience in Canada
  • Completing additional education or credential assessments
  • Exploring Provincial Nominee Programs (PNPs)

At Northfield & Associates, we help clients identify strong pathways to permanent residence. Even if you do not have a job offer, you may still qualify under the Federal Skilled Worker Program, Canadian Experience Class, or a PNP stream.

Canada’s New Immigration Minister: What Lena Metlege Diab’s Appointment Means for the Future of Immigration Policy

March 14, 2025 — Mark Carney a renowned economist and former central banker was sworn in as Canada’s 24th prime minister. Shortly after assuming office, Carney began outlining his immigration policy priorities, which include:

  • Capping immigration levels until they return to pre-pandemic norms;
  • Prioritizing permanent residency (PR) for temporary residents already in Canada; and
  • Reducing reliance on temporary foreign workers.

As part of a broader cabinet reshuffle ahead of the upcoming federal election, Carney appointed Lena Metlege Diab as the new Minister of Immigration, Refugees and Citizenship Canada (IRCC), replacing Rachel Bendayan, who briefly held the role after Marc Miller.

Who Is Lena Metlege Diab?

Lena Metlege Diab is a seasoned lawyer, entrepreneur, and community advocate, born in Halifax to Lebanese immigrant parents. She is trilingual in English, French, and Arabic, and holds degrees in commerce and law from Saint Mary’s University and Dalhousie University.

In provincial politics, Diab served as Nova Scotia’s Minister of Immigration from 2013 to 2021, where she was instrumental in expanding immigration pathways through new Express Entry-aligned streams and entrepreneur programs. She also held positions as Attorney General and Minister of Justice, the first woman of Lebanese descent to do so in Canada.

Her appointment is widely viewed as a strong signal of the government’s commitment to inclusion, integration, and experience-based immigration reform.

Implications for Immigration Policy

Diab’s legal expertise and deep background in immigration policy suggest she will bring a measured, evidence-based approach to her new role. While no immediate shifts are anticipated, the following developments are likely under her leadership:

  • Support for Francophone immigration outside Quebec
  • Continued streamlining of PR pathways for in-Canada temporary residents
  • Targeted updates to work permit systems and international student programs

Impact on International Students

Significant reforms affecting international students—such as study permit caps and tighter post-graduation work eligibility were introduced under former ministers Marc Miller and Rachel Bendayan. Although Diab has yet to propose new changes, Prime Minister Carney has emphasized ongoing oversight in this area.

Post-secondary institutions may face stricter compliance requirements, and international students are advised to stay informed as policy developments unfold.

Permanent Residency and Work Permits

The Carney government has clearly signaled that it will prioritize those already living and contributing in Canada for permanent residency. Minister Diab is expected to continue along this path by:

  • Facilitating PR transitions for international graduates and temporary foreign workers;
  • Potentially tightening access for new temporary entrants.

A Measured Path Forward

Diab’s appointment represents continuity and stability rather than radical change. With a federal election on the horizon, large-scale immigration reforms are unlikely. Instead, stakeholders can expect:

  • Incremental improvements to PR processing for in-Canada applicants;
  • More transparent regulation of international student programs;
  • A renewed focus on Francophone and equity-based immigration streams.

Her leadership offers promise for more structured, transparent, and inclusive immigration policy especially for communities long advocating for greater representation and access within the Canadian immigration system.

Canadian Immigration Update: 2025–2027 Levels Plan and Provincial Changes

Canadian Immigration Update: 2025–2027 Levels Plan and Provincial Changes

In October 2024, the Government of Canada announced its Immigration Levels Plan for 2025–2027, outlining significant changes to the country’s immigration framework.

Key Federal-Level Changes:

Reduction in Permanent Resident (PR) Targets:

Immigration, Refugees and Citizenship Canada (IRCC) reduced the number of permanent resident admissions for the upcoming years.

Introduction of Temporary Resident Targets:

For the first time, IRCC introduced targets for temporary resident admissions.

Target Allocations by Category:

The plan includes specified percentages for temporary residents and French-speaking immigrants (outside Quebec), beginning in 2025.

In-Canada Transitions:

Over 40% of 2025 PR admissions are expected to be granted to individuals already in Canada as temporary workers or international students.

Refugees and Protected Persons:

The government has reduced admissions in this category, with changes already reflected in recent policies and program reforms.

New PR Pathways:

Additional permanent residency pathways have been introduced and implemented through policy changes.

Provincial Immigration Program Adjustments:

Provincial Nominee Program (PNP) Reductions:

The federal government decreased PNP allocations by 50% for 2025.

Provincial Negotiations:

Some provinces, including Newfoundland and Labrador and New Brunswick, successfully negotiated for increased nomination spaces.

Stream Modifications:

Several provinces have paused, suspended, or reopened specific immigration streams. Others have imposed new limits on the number of applications they will accept this year.

Eligibility Changes:

Many provinces revised their eligibility criteria—some temporarily, others permanently.

Targeted Occupations:

Certain provinces now restrict nominations to high-demand sectors such as healthcare and construction, and exclude specific occupations from eligibility.

Expression of Interest (EOI) Systems:

Provinces like Yukon and Newfoundland and Labrador introduced EOI systems for their job-offer streams, replacing direct application models previously in place.

These changes reflect a broader shift in Canada’s immigration strategy, focusing on economic needs, labour market demands, and regional priorities. Applicants and stakeholders are encouraged to stay informed and consult official sources or legal professionals to navigate the evolving landscape.

Important Update: Changes to Express Entry Category-Based Selection – February 2025

On February 27, 2025, Immigration, Refugees and Citizenship Canada (IRCC) announced significant updates to the category-based selection process under the Express Entry system. These changes directly impact which candidates are prioritized for invitations to apply for permanent residence (PR).

Key Changes Announced

  • New Category Introduced
A new “Education” category was added, including five eligible occupations that align with national labor market priorities.
  • Category Removed
The “Transportation” category has been eliminated from category-based draws.
  • Updates Across All Categories
All existing categories underwent revisions, with several occupations added or removed based on evolving workforce demands.

Priority Categories for 2025

IRCC confirmed that the Express Entry priority categories for 2025 will focus on:

  • French-language proficiency
  • Trade occupations
  • Healthcare and social services occupations

Candidates who meet the criteria for these categories will benefit from a higher likelihood of receiving an Invitation to Apply (ITA) for permanent residence during category-based draws.

What is Express Entry?

Express Entry is the federal government’s electronic application management system for economic immigration programs. Each year, the system issues over 100,000 ITAs to qualified candidates based on factors such as age, education, work experience, language proficiency, and category eligibility.

Category-based selection enhances the government’s ability to target applicants who meet specific labor market and demographic needs across Canada.

Why This Matters

If you are an Express Entry candidate or planning to become one, these updates may significantly affect your chances of receiving an ITA. Staying informed and ensuring your profile aligns with current priorities is essential.

At Northfield & Associates, we help clients:

  • Evaluate their eligibility under the revised category-based selection criteria
  • Strategically tailor their Express Entry profiles for maximum competitiveness
  • Navigate changes to federal and provincial immigration policies with clarity

Understanding Canada’s Immigration Policies for 2025

Canada’s immigration policies have experienced significant shifts leading into 2025, impacting the nation’s economy, workforce, and societal dynamics. Recent policy adjustments aim to balance economic needs with public concerns, particularly regarding housing affordability and infrastructure strain. For individuals seeking legal guidance on immigration matters, Northfield & Associates, a trusted consulting firm in Ontario, offers expert assistance in navigating these complex policies.

Canada Immigration Policies:

A Changing Landscape

Historical Trends and Policy Evolution

Between 2000 and 2014, Canada admitted between 200,000 and 271,000 immigrants annually, primarily through economic, family, and humanitarian programs. Under Prime Minister Justin Trudeau’s administration, these numbers increased significantly, with immigration targets reaching 500,000 new permanent residents per year by 2025. However, escalating concerns over housing shortages and infrastructure capacity have prompted a re-evaluation of these targets.

Key Changes in Canada Immigration for 2025

In October 2024, the Canadian government announced a substantial reduction in immigration targets:

  • 2025: 395,000 new permanent residents (down from the previously planned 500,000)
  • 2026: 380,000 permanent residents
  • 2027: 365,000 permanent residents

This policy shift reflects the government’s response to public concerns about housing affordability and the capacity of social services to accommodate rapid population growth.

For individuals seeking to immigrate, these changes underscore the importance of working with experienced immigration lawyers, such as those at Northfield & Associates, who can navigate the evolving policies and maximize the chances of approval.

Impact on Temporary Residents and International Students

The government has also implemented measures to regulate the influx of temporary residents, including international students and foreign workers. In January 2024, a two-year cap on international student permits was announced, and the number of temporary foreign workers is under review to alleviate pressures on housing and public services.

If you are an international student or a worker concerned about your status in Canada, Northfield & Associates can provide legal assistance in securing permits, extending visas, and exploring permanent residency options.

Public Opinion and Political Influence

Public sentiment has increasingly reflected concerns about rapid population growth’s impact on housing and services. Polls indicate a growing belief that Canada might be accommodating too many immigrants, prompting political debates and influencing policy revisions. Opposition leaders have criticized the government’s previous approach, advocating for immigration levels aligned with housing availability and infrastructure capacity.

At Northfield & Associates, we stay ahead of these policy discussions to ensure our clients receive strategic legal advice based on the latest immigration regulations.

Prime Minister Justin Trudeau’s announcement Canada to Upgrade Diplomatic Mission to Embassy in Phnom Penh – A Significant Milestone in Bilateral Relations

February 03, 2025 — Phnom Penh — Canada will significantly upgrade diplomatic mission to embassy in Phnom Penh with the opening of a full embassy, accompanied by a resident ambassador, slated for 2025. This move follows an announcement by Prime Minister Justin Trudeau during the 2024 ASEAN Leaders’ Summit in Vientiane, Lao PDR. This upgrade marks a critical step in strengthening the enduring relationship between Canada and Cambodia, a bond that has been nurtured for decades.

Canada has played a pivotal role in Cambodia’s development, contributing to the nation’s peace and stability since the 1950s. Over 1,000 Canadian soldiers have served in Cambodia since 1954, underscoring Canada’s deep commitment to the region.

In recent years, diplomatic and economic relations between Canada and Cambodia have flourished. As of 2023, Canada is the 10th-largest donor of Official Development Assistance (ODA) to Cambodia, contributing CAD $23.1 million (approximately USD $17 million) during the 2022–2023 fiscal year. One of the most notable contributions was Canada’s funding of the Anti-Personnel Mine Ban Convention Review Conference held in Siem Reap in November 2024, where Canada pledged an additional USD $2.1 million to support ongoing mine clearance efforts. This brings Canada’s total contribution to over USD $50 million in the fight against landmines in Cambodia.

Trade relations between the two countries have also seen significant growth. Canada is now Cambodia’s seventh-largest trading partner, with Cambodian exports to Canada totaling USD $2.1 billion in 2023. This thriving trade relationship is expected to be further strengthened with the participation of over 60 Canadian business leaders in an upcoming trade mission to Phnom Penh in May 2025. This mission reflects the growing interest in Cambodia’s emerging market and represents an excellent opportunity for Canadian firms, including those at Northfield & Associates, to deepen their involvement in the region.

Northfield & Associates and the Future of Canada-Cambodia Relations:
For Northfield & Associates, the increased diplomatic engagement between Canada and Cambodia offers significant opportunities to expand its presence in Cambodia’s rapidly evolving business landscape. As Canada’s role in the region grows, so too does the potential for Northfield & Associates to leverage its expertise in navigating the complexities of international trade and investment. The company stands to benefit greatly from enhanced bilateral ties, especially given the influx of Canadian businesses seeking to engage more deeply with Cambodia’s dynamic economy.

The elevation of Canada’s diplomatic mission to an embassy in Phnom Penh is a reflection of the growing partnership between the two nations. As this relationship continues to mature, both countries are poised to reap the benefits of expanded trade, investment, and collaboration, fostering a shared future of prosperity and stability in the region.

Important Update: Changes to Provincial Immigration Programs in 2025

What You Need to Know About PNP Reductions and Policy Shifts Across Canada

The Canadian federal government has announced a 50% reduction in Provincial Nominee Program (PNP) allocations for 2025, significantly impacting provincial immigration programs nationwide.

In response, some provinces such as Newfoundland and Labrador and New Brunswick have successfully negotiated with Immigration, Refugees and Citizenship Canada (IRCC) for increased nomination spaces despite the overall cuts.

Across the country, provinces are adapting to these changes in various ways:

  • Program Adjustments
Several provinces have temporarily paused or permanently suspended certain immigration streams, while reopening others or implementing strict intake limits on the number of applications they will accept this year.
  • Eligibility Changes
Criteria for many PNP streams have been narrowed or updated. In some cases, these changes are permanent, while others are temporary and responsive to current labour market conditions.
  • Sector-Specific Focus
Many provinces are now prioritizing high-demand sectors, such as healthcare and construction, while excluding certain occupations from eligibility or limiting applications to specific industry needs.
  • New Expression of Interest (EOI) Systems
Provinces like Yukon and Newfoundland and Labrador have launched EOI systems for applicants seeking nomination under job offer streams. These new systems replace the previous model, which allowed eligible candidates to apply directly without submitting an EOI.

What This Means for Applicants
If you’re considering immigration through a Provincial Nominee Program or the Atlantic Immigration Program, it’s more important than ever to understand the latest eligibility criteria, program availability, and application processes.

At Northfield & Associates, our team closely monitors these developments and provides up-to-date, strategic guidance to help you:
• Assess your eligibility under the new provincial frameworks
• Identify viable immigration pathways despite allocation cuts
• Prepare competitive applications aligned with evolving provincial priorities
