LMIA Exempt Work Permit vs LMIA Work Permit

he main benefit of having a LMIA exempt work permit (Open Work Permit) is that you have the flexibility to work anywhere. Below we have outlined different situations that would be eligible to apply for an Open Work Permit:

While living in Canada, you would be eligible for an Open Work Permit if you have submitted a common law or spousal sponsorship application. If your spouse or common law partner is studying in Canada or they have an employer specific LMIA work permit, then you as the spouse or the common law partner, would be eligible for an Open Work Permit.

You would also be eligible for an Open Work Permit if you have received an invitation to apply for an Express Entry and you have submitted your application.

As a vulnerable worker, you could qualify for a 6-month Open Work Permit.

If you are an approved Refugee claimant, waiting for your hearing at the Immigration Refugee Board, then you would be eligible for an Open Work Permit. As well, if you are under a removal order that has been stayed, you would still be eligible for an Open Work Permit.

LMIA Work Permit

A Labour Market Impact Assessment (LMIA) Work Permit on the other hand is an employer specific work permit. This means you can only work for that authorized employer.

Exemptions under LMIA are offered on a limited basis. One example of the LMIA exemption work permit is the intra company transfer. This is when you transfer employees from one company to the other. You need to show that the Canadian company and company in another country have affiliations, or are related, and they do business together. The categories for an intra company transfer are: professional employees, executive managers or employees that have special knowledge.

There are certain eligibility requirements which include that employees would need to show that they have worked for the sister company in the foreign country for at least one year as well as meet other job requirements.

One nice thing about the LMIA exemption code work permit is that if you are from a VISA exempt country, then you can apply for a work permit upon entry into Canada at a Port of Entry if you meet all of the requirements.

Federal Court Upholds IRCC’s Authority to Refuse Study Permit Applications Based on Low Grades

In a recent ruling, the Federal Court has affirmed the reasonableness of Immigration, Refugees and Citizenship Canada (IRCC) visa officers’ decision to refuse study permit applications when applicants have obtained low grades in “core courses” or “core subjects” related to their intended program of study in Canada.

The case of Barot vs. Canada (Citizenship and Immigration) brought this matter to light. The applicant, a 23-year-old Indian citizen, sought judicial review of an IRCC visa officer’s decision to reject his study permit application. The applicant held a Bachelor’s Degree in Management Studies from the University of Mumbai in 2020 and applied for a study permit in 2021 to pursue a post-graduate certificate in entrepreneurship management at Canadore College.

Despite being accepted by Canadore College, the applicant’s study permit application was denied by the visa officer, who deemed the applicant’s academic proficiency insufficient to complete his studies in Canada. The applicant’s submitted transcripts revealed below-average grades, particularly in core subjects. Consequently, the officer concluded that the applicant lacked genuine student status and that his chosen program of study was unreasonable.

Additionally, the Court ruled that visa officers are not obligated to provide explicit explanations for considering an applicant’s grades to be subpar, even if a Canadian post-secondary institution has admitted the student.

This ruling has significant implications, highlighting the wide discretion visa officers possess in refusing applications. If you are a student with lower grades, it is essential to address concerns proactively and present compelling arguments regarding how those grades will or will not impact your ability to complete your proposed studies.

This decision underscores the importance of maintaining academic proficiency and highlights the need for students to demonstrate their capability to excel in their chosen field of study. Guide to Applying for a Student Visa

If you’re considering studying in Canada and wish to apply for a study permit, it’s important to follow the application process diligently. To be eligible for a study permit, prospective students must fulfil the following criteria:

1. Secure a Letter of Acceptance

Obtain a letter of acceptance from a designated learning institution in Canada.

2. Show Financial Support

Demonstrate that you have sufficient financial resources to cover your first year of tuition, living expenses, and return transportation to your home country.

3. Quebec Acceptance Certificate (CAQ) (if applicable)

If you plan to study in Montreal or elsewhere in the Province of Quebec, obtain a Certificat d’acceptation du Quebec (CAQ).

4. Maintain a Clean Record

Ensure that you have a clean criminal record and do not pose a risk to Canadian security. In some cases, IRCC may request a police clearance certificate.

5. Maintain Good Health

Be in good health. IRCC may request a medical examination to verify your health status.

6. Demonstrate Intent to Depart

Convince the immigration officer that you have genuine intentions to leave Canada at the end of your authorized stay as granted by the study permit.

It is advisable to submit study permit applications as soon as you receive your letter of acceptance from the learning institution, as processing times may vary.

Student Direct Stream (SDS)

The Student Direct Stream (SDS) program expedites the study permit application process for eligible international students, making it faster and more efficient. The SDS is available to residents of the following 15 countries:

Applications eligible for SDS are typically processed within 20 days. To apply for a Canadian study permit through the SDS program, prospective students must:

1. Provide a Letter of Acceptance

Submit a copy of the letter of acceptance from a Canadian Designated Learning Institution.

2. Complete Medical Examination

Present a confirmation document for the upfront medical examination.

3. Demonstrate Financial Capacity

Prove that you have obtained a Guaranteed Investment Certificate (GIC) of $10,000 and that you have paid the tuition fees for the first year of study.

4. Language Proficiency

Show proof of language test results, completed within two years of the SDS application, demonstrating an IELTS score of 6 in English or NCLC 7 for French.

5. Submit Application at a Visa Application Centre (VAC):

Submit the study permit application at a designated Visa Application Centre.

Unlocking Your Path to Return to Canada: Understanding the Authorization to Return to Canada (ARC) Permit

FOR IMMEDIATE RELEASE

If you have received a removal order and wish to return to Canada, the Authorization to Return to Canada (ARC) may be your ticket back. The type of ARC application you need depends on the type of removal order you have received. It’s important to note that the ARC application is typically submitted along with the main application unless you are from a visa-exempt country.

Departure Order:

If you have received a departure order and have left Canada within 30 days, you may not require an ARC and can return through any port of entry. However, if you have not verified your departure, your removal order may be converted into a Deportation Order, which will require you to apply for an ARC to return to Canada.

 Deportation Order:

If you have received a deportation order and wish to return to Canada before your deportation order expires, you will need to apply for an ARC. It’s important to note that a deportation order is different from a removal order, as it is issued when you do not leave Canada within 30 days of your issued departure order. If you were issued a deportation order due to criminal convictions, you may also need to apply for criminal rehabilitation before applying for ARC. You may require a Temporary Resident Permit (TRP) in addition to ARC, and an interview may also be required. 

Exclusion Order:

If you were issued an exclusion order and left Canada within 12 months since it was issued, and have a certificate of departure, you may not need an ARC. However, if you wish to return before 12 months have passed, you will need to apply for an ARC.  

Applying for an ARC requires filling out an application and providing relevant information, including the reasons for the removal order, the length of time of the order issued, reasons for wishing to enter Canada, a declaration of better behaviour in the future, and evidence of your current situation.

Post Graduate Work Permit Tips

Prior to picking the program you wish to study as well as the school of your choice whether it is a college or university, make sure that the program and learning institution are approved for the Post Graduate Work Permit. The Post Graduate Work Permit is extremely important because it allows you to extend your stay in Canada and it also gives you Canadian experience which will be helpful with your Express Entry.

To be approved for a Post Graduate Work Permit you would have to study for at least 8 months full time. What many students are doing, they are enrolling in Colleges and Universities programs that are 2 years or more. If the program is 2 years or more and its full time, you automatically get a Post Graduate Work Permit for 3 years. If the program is 8 months full time but less than 2 years, then the Post Graduate Work Permit would be the same as the length of your program.

So, if your program is 2 years or more, you automatically are considered for a Post Graduate Work Permit that is for 3 years. Most students opt for this option because the PGWP is an open work permit and it gives you the possibility to work anywhere.

One important thing you need to keep in mind is that you would have to study full time. You cannot apply for a PGWP if you are studying part time. If you took a program that was 3 years or 4 years, but it was part time, you would not be eligible.

Also, this is an application process. You would have to apply, and you would have a set time frame in which to do so. The application should be submitted once you have graduated and you have received your transcripts.

One of the benefits of the PGWP, is that you are exposed to the workforce. You can work anywhere you desire but it is recommended that you work at a job that is recognized within the National Occupational Classification (NOC) system as A, B or zero. Working within these categories will come in handy when you apply for your Express Entry.

Unfortunately, it does come as a surprise to many applicants when they’re applying for permanent residency or Express Entry that they don’t have the right Canadian experience because the jobs that they have worked at are not in the proper NOC category; A, B or zero.

Understanding the Second-Generation Cut-Off Rule for Canadian Citizenship

Eligibility for Canadian citizenship is based on certain criteria, including being born outside of Canada with at least one biological or legal parent who was a Canadian citizen at the time of the individual’s birth. However, Canada restricts citizenship by descent to the first generation born outside of Canada to a Canadian parent.

Since its inception in 1947, the Canadian Citizenship Act has undergone multiple amendments. Initially, the Act allowed Canadian parents to pass citizenship to their children born outside of Canada across successive generations, provided that the foreign-born descendants registered with the government within a specific timeframe.

In 2009, a significant change known as the second-generation cut-off was introduced. This amendment was implemented to discourage the concept of “Canadians of convenience,” as stated by the then-immigration minister, Diane Finley. Its purpose was to ensure that citizens have a genuine connection to Canada. Consequently, citizenship transmission by descent was limited to only the first generation born abroad, emphasizing the importance of a tangible link between individuals and the country.

By understanding the provisions of the Canadian Citizenship Act and its historical evolution, we gain insights into the rationale behind the second-generation cut-off rule and its role in fostering a meaningful connection between citizens and Canada.

The Current Lawsuit

A current lawsuit involves 23 individuals from seven families who are challenging the second-generation cut-off rule introduced in 2009. They argue that this rule discriminates based on birthplace, violates mobility and liberty rights, and disproportionately disadvantages women who had to give birth outside Canada due to circumstances beyond their control. The Ontario Superior Court of Justice is tasked with determining whether Canada violates the Charter by limiting the transmission of citizenship by descent to only the first generation born abroad.

The families involved in the lawsuit, as reported by the Toronto Star, contend that the government’s stance oversimplifies the complex realities surrounding the choices they faced, such as access to healthcare, healthcare costs, travel risks, loss of employment and income, and hindrances to career advancement.

The initial justification provided by Minister Finley for the second-generation cut-off was to address concerns regarding “Canadians of convenience” who lacked a genuine connection to Canada and sought citizenship solely to preserve the option of living in the country. However, the applicants in the lawsuit are not Canadians of convenience. They returned to Canada as young children and spent their formative years in the country, according to Sujit Choudry, legal counsel for the families.

While Canadians born in Canada and naturalized Canadians can pass their citizenship to their children born abroad, Canadians born abroad by descent are unable to do so. The families’ legal counsel argues that this distinction is arbitrary and represents a clear form of discrimination.

How to Apply for Proof of Citizenship?

To obtain proof of Canadian citizenship, you need to follow the official process established by the Canadian government. This involves applying for a “proof of Canadian citizenship” or a Canadian citizenship certificate, which is issued by Immigration, Refugees and Citizenship Canada (IRCC). Along with a Canadian birth certificate, the citizenship certificate is one of the two accepted documents for proving Canadian citizenship when dealing with Passport Canada.

You have the flexibility to apply for a Canadian citizenship certificate at any point in your life, regardless of whether your Canadian parent is alive or deceased. To initiate the application, you will need to download the application package provided on IRCC’s website. As part of the application, you will be required to provide evidence that one of your legal or biological parents at the time of your birth was a Canadian citizen.

The application can be submitted conveniently online through IRCC’s website. Once your application is received, you will receive an “acknowledgement of receipt” confirming that your application has been received. Your application will then undergo review and processing by the relevant authorities at IRCC.

Unlocking Canada: The Temporary Resident Permit (TRP) – Your Key to Overcoming Inadmissibility

If you have received a removal order and wish to return to Canada, the Authorization to Return to Canada (ARC) may be your ticket back. The type of ARC application you need depends on the type of removal order you have received. It’s important to note that the ARC application is typically submitted along with the main application unless you are from a visa-exempt country.

Departure Order:

If you have received a departure order and have left Canada within 30 days, you may not require an ARC and can return through any port of entry. However, if you have not verified your departure, your removal order may be converted into a Deportation Order, which will require you to apply for an ARC to return to Canada.

Deportation Order:

If you have received a deportation order and wish to return to Canada before your deportation order expires, you will need to apply for an ARC. It’s important to note that a deportation order is different from a removal order, as it is issued when you do not leave Canada within 30 days of your issued departure order. If you were issued a deportation order due to criminal convictions, you may also need to apply for criminal rehabilitation before applying for ARC. You may require a Temporary Resident Permit (TRP) in addition to ARC, and an interview may also be required.

Exclusion Order:

If you were issued an exclusion order and left Canada within 12 months since it was issued, and have a certificate of departure, you may not need an ARC. However, if you wish to return before 12 months have passed, you will need to apply for an ARC.

Applying for an ARC requires filling out an application and providing relevant information, including the reasons for the removal order, the length of time of the order issued, reasons for wishing to enter Canada, a declaration of better behaviour in the future, and evidence of your current situation.

Study Permit & Studying In Ontario, What You Need To Know.

Making a decision to study in Ontario or in Canada is a big decision and it’s something that you need to take time to think about. There are expenses that are related to it and it’s not just the tuition that you need to be concerned about. You need to think about your lifestyle, where you’re going to stay, transportation and living expenses.

Ontario has a lot of Great schools, colleges and universities. Before asking for professional legal advice, you should have already done your research to know which school, college or university you prefer to attend.

To be approved for a study permit you are required to apply for a study permit if your education is 6 months or longer. If you are coming into Canada to study English or to improve your English and the course is up to six months, you don’t need a study permit. If you are enrolling in a college or university, you would need a study permit because usually the programs are longer than 6 months.

You also need to be enrolled in a Designated Learning Institution (DLI) in order to be approved for a study permit. A DLI is a school approved by a provincial or territorial government to host international students. All primary and secondary schools in Canada are designated learning institutions. If you plan to attend a post-secondary school, make sure it is on this list.

You need to know if you are eligible to work after you graduate. Not all designated learning institutions make you eligible for the Post-Graduation Work Permit Program. Along with graduating from an eligible designated learning institution, you need to meet all other criteria to get a post-graduation work permit. Find out more on the DLI website. If you apply at a program in a popular college or university, you would be eligible for a Post-Graduate Work Permit once you graduate. This permit would allow you to work at any desired workplace for a certain amount of years.

Most universities in Ontario; Brock, York, University of Guelph, University of Toronto, Ryerson, etc., are approved for the Post-Graduate Work Permit. Most colleges like Seneca, George Brown, Humber, etc. also have programs that are eligible for Post-Graduate Work Permit.

Once you have applied to the school of your choice, you must have a Letter of Acceptance. Without a Letter of Acceptance, you cannot start a study permit application. Most colleges or universities will require that you take a language requirement test. They will also require you to make a tuition deposit. You will need the confirmation of this deposit once you have been accepted in order to apply for your study permit application.

Another thing that is required is Proof of Funds that are separate from your tuition funds or your education funds. You need to show that you have enough money to survive as a student without work in Canada or without any financial assistance. Usually $10,000 is minimum required to show that you have enough funds to survive for 1 year.
